General Terms and Conditions of Sale

These General Terms and Conditions of Sale (“Terms and Conditions of Sale” or “CGV”) govern purchases made by consumers through UNIKIFF.com.

They apply to sales concluded between the seller identified below and any consumer purchasing products for purposes outside their trade, business, craft or profession.

The online store is operated using the Shopify e-commerce platform.

Article 2 – Purpose and Scope

These Terms and Conditions of Sale define the contractual relationship between UNIKIFF and consumers purchasing products through UNIKIFF.com.

Before placing an order, the customer is invited to read these Terms and Conditions of Sale together with the Shipping Policy, Return & Refund Policy and Privacy Policy.

By confirming an order, the customer acknowledges having had the opportunity to review the applicable contractual information before purchase.

The Terms applicable to an order are those in force on the date the order is placed.

Nothing in these Terms limits or excludes any mandatory consumer rights provided by applicable law.

Article 3 – Products

UNIKIFF specializes in the online sale of vegan combat boots.

The essential characteristics of each product, including available designs, sizes and other relevant information, are displayed on the corresponding product page.

UNIKIFF makes reasonable efforts to ensure that product descriptions and photographs accurately represent the products offered for sale.

However, colors may appear slightly different depending on the customer's screen, display settings or lighting conditions.

Minor variations resulting from manufacturing or printing processes may occur where they do not affect the conformity, essential characteristics or normal use of the product.

Article 4 – Made-to-Order Production

UNIKIFF boots may be produced after the customer places an order.

Production generally takes approximately 5 to 7 business days before shipment.

A standard UNIKIFF product being produced after an order is placed does not, by itself, mean that the product is personalized or excluded from statutory consumer rights.

Where UNIKIFF were to offer a product specifically personalized or manufactured according to individual specifications requested by a customer, any applicable restriction on the right of withdrawal would be clearly communicated before purchase.

Article 5 – Prices

Product prices are displayed on UNIKIFF.com in the currency applicable to the customer's selected market or location.

Where required by applicable law, displayed consumer prices include applicable taxes.

Shipping charges and any additional amounts collected by UNIKIFF are displayed during checkout before the customer confirms payment.

The total amount payable is presented to the customer before the order is finalized.

UNIKIFF may change product prices at any time.

However, the price applicable to an order is the price displayed and confirmed when the customer places that order.

For international deliveries, import duties, customs charges or local taxes not collected during checkout may be payable by the customer to the relevant local authority.

Article 6 – Orders

The customer selects the product and size they wish to purchase and adds the product to their shopping cart.

Before confirming the order, the customer is responsible for checking the order details, including:

  • Product

  • Size

  • Quantity

  • Delivery address

  • Billing information

  • Shipping method

  • Total price

The customer must provide complete and accurate information.

An order is considered submitted when the customer completes the checkout process and confirms the purchase.

An order confirmation is normally sent electronically to the email address provided during checkout.

UNIKIFF may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, obvious pricing errors, product unavailability, invalid delivery information or legal restrictions preventing fulfillment.

If UNIKIFF cancels an order after payment has been collected, the amount paid for the cancelled order will be refunded.

Article 7 – Payment

Payment must be made using one of the payment methods displayed during checkout.

The payment methods available may vary depending on the customer's country, currency or order.

Payments may be processed through Shopify or other authorized payment service providers.

The customer confirms that they are authorized to use the payment method selected.

Payment information is processed securely by the relevant payment provider.

UNIKIFF does not directly store complete payment card information processed by those providers.

Article 8 – Production, Shipping and Delivery

Production and delivery information is detailed in the Shipping Policy available on UNIKIFF.com.

UNIKIFF vegan combat boots generally require approximately:

Production: 5–7 business days.

Estimated transport time after production is generally approximately:

Delivery: 7–15 business days, depending on destination and shipping conditions.

These delivery periods are estimates unless a specific binding delivery date has been expressly agreed.

UNIKIFF will provide the customer with the applicable delivery information before the order is completed.

If no delivery date or period has been agreed, applicable consumer law regarding delivery periods shall apply.

Where applicable under French consumer law, if the seller fails to deliver within the agreed period, the customer may exercise the remedies provided by law.

Article 9 – Transfer of Risk

When UNIKIFF arranges the shipment of the order using a carrier offered through the Website, the risk of loss or damage remains with the seller until the customer, or a third party designated by the customer, takes physical possession of the goods.

If the customer independently chooses and instructs a carrier that was not proposed by UNIKIFF, different statutory rules concerning the transfer of risk may apply.

Customers are encouraged to inspect their package and product upon receipt.

The customer's statutory consumer rights are not affected by the absence of reservations made to the carrier at the time of delivery.

Article 10 – Right of Withdrawal

Consumers benefiting from French or European Union consumer protection rules have, in principle, a legal period of 14 days from receipt of the goods to exercise their right of withdrawal from a distance purchase without having to provide a reason.

To exercise this right, the customer must inform UNIKIFF of their decision before the end of the 14-day withdrawal period.

The customer is not required to use the model form, provided that the statement clearly expresses the decision to withdraw.

The simple return of a package without a prior statement expressing the decision to withdraw does not, by itself, constitute valid exercise of the right of withdrawal.

After notifying UNIKIFF of the withdrawal, the customer must return the goods within 14 days.

Unless UNIKIFF agrees otherwise or applicable law requires UNIKIFF to bear the cost, the direct cost of returning a product following a change of mind is the responsibility of the customer.

Article 11 – Condition of Returned Products

Customers may inspect and try on the boots to determine their nature, characteristics and fit in the same way that would reasonably be possible in a physical store.

Boots should therefore be tried on indoors and on a clean surface.

Returned products should not show signs of outdoor wear, dirt, alteration, damage or use beyond what is reasonably necessary to inspect and try on the product.

Where legally permitted, the customer may be responsible for any diminished value resulting from handling beyond what was necessary to establish the nature, characteristics and proper functioning of the goods.

Article 12 – Refund Following Withdrawal

When a valid right of withdrawal is exercised, UNIKIFF will refund the amounts required by applicable consumer law.

For a withdrawal covered by French or EU consumer law, this includes the price paid for the returned goods and, where applicable, the cost of the least expensive standard delivery method offered for the original order.

The refund will be made using the same payment method used for the original transaction unless the customer expressly agrees otherwise and this does not result in additional costs.

The refund will be processed within the legally applicable timeframe.

UNIKIFF may, where permitted by law, defer reimbursement until the returned goods have been received or until the customer provides evidence that the goods have been sent back, whichever occurs first.

Article 13 – Legal Guarantee of Conformity

Consumers benefit from the legal guarantee of conformity provided by Articles L.217-3 and following of the French Consumer Code where applicable.

UNIKIFF, as the professional seller, is responsible for delivering goods that conform to the sales contract.

For new goods, the consumer may invoke the legal guarantee of conformity for defects appearing within two years from delivery, under the conditions provided by law.

Where the legal conditions are met, the consumer is entitled to have the goods brought into conformity through repair or replacement, subject to the conditions and limitations provided by applicable law.

Where bringing the product into conformity is impossible, is not carried out within the legally applicable conditions, or where another situation provided by law applies, the consumer may be entitled to a reduction in price or termination of the contract.

Implementation of the legal guarantee of conformity is free of charge for the consumer.

The legal guarantee applies independently of UNIKIFF's commercial Return & Refund Policy.

Article 14 – Guarantee Against Hidden Defects

The customer may also benefit from the legal guarantee against hidden defects under Articles 1641 and following of the French Civil Code.

A hidden defect is a defect that existed at the time of sale, was not apparent to the buyer and is sufficiently serious to make the product unfit for its intended use or substantially reduce its usefulness.

Under Article 1648 of the French Civil Code, an action based on hidden defects must generally be brought within two years from discovery of the defect.

Where the legal conditions are satisfied, the customer may exercise the remedies provided by the French Civil Code.

Article 15 – Damaged, Defective or Incorrect Products

If a customer receives boots that are damaged, defective or different from the product ordered, they should contact UNIKIFF as soon as possible.

The customer should include the order number and clear photographs showing the issue where possible.

UNIKIFF will review the claim and provide the appropriate remedy in accordance with applicable consumer law.

Where a product is confirmed as defective, damaged or non-conforming, the customer will not be required to bear costs that legally fall on the seller.

Article 16 – Retention of Title

Products remain the property of UNIKIFF until full payment of the purchase price.

The provisions concerning transfer of ownership do not alter the statutory rules governing the transfer of risk to consumers.

Article 17 – Personal Data

Personal information collected in connection with orders and use of UNIKIFF.com is processed in accordance with our Privacy Policy.

The Privacy Policy explains, among other matters, how personal information is collected and used, the legal bases for processing, cookies and tracking technologies, retention periods and the customer's data protection rights.

Article 18 – Intellectual Property

The UNIKIFF Website and its content, including text, graphics, branding, logos, photographs, videos, product presentations and other protected material, are subject to applicable intellectual property rights.

No content may be reproduced, distributed, modified or commercially exploited without the authorization of the relevant rights holder, except where permitted by law.

Article 19 – Liability

UNIKIFF is responsible for fulfilling its contractual and statutory obligations in accordance with applicable law.

UNIKIFF cannot be held responsible for losses resulting exclusively from events outside its reasonable control where liability may legally be excluded.

Nothing in these Terms excludes or restricts mandatory consumer rights or any liability that cannot legally be excluded.

Article 20 – Force Majeure

UNIKIFF shall not be responsible for failure or delay in performing an obligation where performance is prevented by an event constituting force majeure under applicable French law.

Where such an event materially affects an order, UNIKIFF will inform the customer where reasonably possible.

Mandatory consumer rights relating to non-delivery, cancellation or reimbursement remain applicable.

Article 21 – Governing Law

These Terms and Conditions of Sale are governed by French law.

However, consumers residing outside France retain the benefit of any mandatory consumer protection provisions applicable to them that cannot lawfully be excluded by contract.

Article 22 – Complaints and Consumer Mediation

In the event of a complaint, the customer should first contact UNIKIFF so that an amicable solution can be sought.

Under French consumer law, after first submitting a written complaint directly to UNIKIFF, the consumer may have the right to refer the dispute free of charge to a consumer mediator.

Mediation is an alternative dispute resolution process and does not prevent the consumer from bringing the matter before a competent court where applicable.

Article 23 – Courts and Disputes

If an amicable resolution or mediation does not resolve the dispute, the dispute may be brought before a court having jurisdiction under applicable law.

Nothing in these Terms requires a consumer to bring proceedings exclusively before the courts of Lons-le-Saunier.

Consumers retain any choice of jurisdiction granted to them by applicable consumer and procedural law.

Article 24 – Changes to These Terms

UNIKIFF may update these Terms and Conditions of Sale to reflect legal, regulatory, technical or commercial changes.

The Terms applicable to an order remain those that were in force when the customer placed that order.
